Rent-to-own homes in Jacksonville, FL: a research guide

By Rent to Own Guide · Published · Updated · How we research

Short answer
A Jacksonville rent-to-own deal is governed mostly by its contract and Florida's general law. Two Florida statutes are worth knowing before you sign: landlord–tenant protections can stop applying once enough has been paid under a contract of sale, and instruments securing payment of money can be treated as mortgages. Check the owner, liens, and taxes in Duval County records before paying, and have a Florida attorney review the contract.

Florida law in brief

Fla. Stat. § 83.42(2) excludes occupancy under a contract of sale from the landlord–tenant act once the buyer has paid 12 months' rent, or one month's rent plus a deposit of at least 5% of the price. Fla. Stat. § 697.01 treats instruments that secure payment of money as mortgages. Details: Florida guide.

Check a Jacksonville property before you pay

  1. Owner of record — Duval County Property Appraiser. Use the real estate property search linked from the Property Appraiser's page to look up the address, and confirm the owner matches the person offering the deal (Property Appraiser).
  2. Mortgages, liens, foreclosure filings — Duval County Clerk. The clerk records deeds, mortgages, judgments, and liens in the county's “Official Records” (Fla. Stat. § 28.222). Search them under the owner's name (Official Records).
  3. Property taxes — Duval County Tax Collector. Tax collectors send bills, collect payments, and sell tax certificates on properties with unpaid taxes (Florida Department of Revenue). Check the parcel's tax status with the Tax Collector.
  4. Title company or attorney. Get a title search before paying an option fee or deposit, and ask whether your agreement should be recorded: in Florida, an unrecorded lease of a year or longer, or an interest in the home, isn't good against later buyers or creditors without notice (Fla. Stat. § 695.01).

Note: the Clerk's and Tax Collector's sites didn't load from our research location on Oct 19, 2026. Their links come from the Clerk's own homepage and the Property Appraiser's page, and we confirmed the Clerk's Official Records page from an archived copy; check the live sites for current features and fees.
