Use it before you pay+

Work through every item before paying an option fee or signing. Anything you can't check off is a question for the seller, a title company, a lender, or a lawyer. Checkmarks stay in your browser only.

1. Ownership and title

The person offering the deal is the owner of record in the county appraisal/assessor database.Fake landlords and unauthorized 'sellers' are a known scam.
County clerk/recorder search under the owner's name shows no unexpected mortgages, liens, lis pendens, or foreclosure filings — or you understand each one.
Property taxes are paid up (tax office lookup or tax certificate).
A title company or real estate attorney has run a title search, and you know whether you can buy title insurance at purchase.
If there's a mortgage: you've asked how the seller's lender treats a lease with an option to buy (due-on-sale risk), and what happens to you if the seller stops paying.
You know whether your option or contract can be recorded with the county, and who records it.

2. The contract

Both the lease and the option/purchase agreement are in writing, signed, and match what you were told.
You know whether it's a lease-option (right to buy) or a lease-purchase (obligation to buy).
The purchase price is fixed in writing, or the formula for setting it is clear.
Option fee: amount, whether it's credited toward the price, and whether any part is ever refundable.
Rent credits: amount, conditions, and exactly what cancels them (for example, one late payment).
Option deadline, how to exercise (written notice? to whom?), and whether it can be extended and at what cost.
What you get back if the seller can't deliver clear title or the home is foreclosed.
Who pays for which repairs, insurance, HOA dues, and property taxes during the term.
Late fees, default notices, and cure periods — and how they compare with your state's rules.
You've read the state-specific rules (our state guides link to them) or had a lawyer explain them.

3. The property

An independent home inspection, paid for by you, before you pay the option fee.
Recent nearby sales support the price (ask an agent or appraiser); a price above appraised value may not be financeable.
No open code violations or unpermitted work you'd inherit; HOA rules allow leasing, if applicable.

4. Financing plan

You've talked to a lender (or a HUD-approved housing counselor) about what you'd need to qualify by the deadline.
You've asked how a lender would treat your option fee and rent credits toward the down payment, and what records they'd need.
You've run the cost calculator for both outcomes — buying and not buying — and can afford the walk-away case.

5. Paying safely

Every payment goes by a traceable method (check, bank transfer) to the owner of record or a title/escrow company, with receipts.
No pressure to sign or pay the same day; you've had time for independent review.
A real estate attorney (and, ideally, a HUD-approved housing counselor) reviewed the contract before you signed.
