Rent-to-own homes in San Antonio, TX: a research guide

By Rent to Own Guide · Published · How we research

Short answer
In San Antonio, a lease with an option to buy falls under Texas's executory-contract law, but a lease-option of three years or less gets only limited protections, so most of the checking is up to you. Bexar County makes that easier than most: its Clerk's records search is free, including viewing documents, and the tax office's search shows the last payment. The City's homebuyer loans go up to $30,000, but its page doesn't say whether funds are available, so call before you count on them.

The Texas rules in brief

Texas Property Code Subchapter D treats an option combined with a residential lease as an executory contract. For terms of three years or less, the protections that apply are a formal default notice with 30 days to cure, a cap on late fees, a ban on forfeiting your option fee for a late payment, a requirement that the seller own the home free of liens, and cancellation if the lot wasn't properly platted (Prop. Code §§ 5.062–5.085). Disclosures, recording, and annual statements are required only for longer terms. Details and a full table: Texas guide.

Check a San Antonio property before you pay

These are Bexar County offices. Small parts of the City of San Antonio lie in neighboring counties; if the home is one of them, use that county's appraisal district, clerk and tax office.

  1. Owner of record: Bexar Central Appraisal District. Search by name, address or property ID, and check that the name matches the person offering the deal. BCAD doesn't take tax payments; taxes are the Tax Assessor-Collector's (BCAD).
  2. Mortgages, liens and foreclosure notices: Bexar County Clerk. The Clerk's Official Records Search is “a free online database where documents can be searched and viewed online, and uncertified copies may be printed directly.” It covers land records and foreclosure notices, and the Clerk also offers a foreclosures map (Bexar County Clerk). A posted foreclosure or a recorded mortgage is a red flag: § 5.085 bars the deal unless strict conditions are met.
  3. Property taxes: Bexar County Tax Assessor-Collector. The account search shows the owner, the current year's tax, exemptions and the last payment. For an official tax certificate, the request form says to email it to the office; the fee is $10 and it takes up to 10 business days (form dated Oct 2021; confirm the fee when you ask).
  4. Title company. Ask for a title search before you pay an option fee, and ask whether you'll be able to buy title insurance at closing.

Homebuyer help in San Antonio (status checked Oct 19, 2026)

  • Homeownership Incentive Programs (HIP): City second loans at 0% with no payments, for homes inside San Antonio city limits. HIP 120 lends $1,000 to $15,000, with 75% forgiven over 10 years; HIP 80 lends $1,000 to $30,000, fully forgiven over 5 or 10 years. Both need a first mortgage from your lender, a HUD-approved 8-hour homebuyer class, and at least $500 in earnest money, and each has its own income and price limits (City of San Antonio). The page doesn't say whether the City has funds left for these loans. The City's FY 2027 budget includes down-payment assistance (City news release, Sep 17, 2026). Call 311 or 210-207-6000 to confirm.
  • For rent-to-own buyers: HIP works with your mortgage lender at purchase, so it helps when you exercise your option and close, not during the lease. The homebuyer class can be done early.
  • TDHCA My First Texas Home: statewide, 2% to 5% down payment assistance with a 620 minimum middle score (program matrix, Aug 17, 2026).
