Rent-to-own homes in Atlanta, GA: a research guide

By Rent to Own Guide · Published · Updated · How we research

Short answer
We didn't find a Georgia statute written specifically for rent-to-own home deals (a research finding, not a legal opinion), so the contract itself carries most of the weight, along with Georgia's rule that bonds for title and contracts to sell land be recorded with the county clerk. Before paying an option fee, confirm the owner, liens, and tax status through Fulton County (or DeKalb, for the parts of Atlanta in that county) and the statewide GSCCCA index, and have a Georgia attorney review the contract.

Georgia law in brief

Recording matters: under O.C.G.A. § 44-2-6, an unrecorded bond for title or contract to sell land can lose priority to a later deed or mortgage from the same seller that is recorded first by someone without notice of it. Georgia's lease-purchase statute covers personal property, not homes. More in our Georgia guide.

Check an Atlanta property before you pay

Most of Atlanta is in Fulton County; part of the city is in DeKalb County, which has its own assessor and tax offices (we haven't researched DeKalb's tools yet).

  1. Owner of record — Fulton County Board of Assessors. The assessors set property values and link to their property search from the county's page (Fulton County). Confirm the owner's name matches the person offering the deal.
  2. Deeds and liens — GSCCCA. The statewide clerks' index lets you search real estate and lien records by name; name searches aren't premium features, while address and instrument-type searches are (GSCCCA). Viewing document images needs an account — $5.00 single-use activation, or monthly plans, plus $0.50 per printed page (account options).
  3. Property taxes — Fulton County Tax Commissioner. Tax bills are viewable online. For 2026, City of Atlanta taxes were due Sept 30 and Fulton County taxes Oct 15, with interest starting the next day (Fulton County, Aug 14, 2026). Unpaid taxes on the seller's home are a red flag.
  4. Title company or attorney. Ask for a title search before paying, and ask about recording your agreement.
