Rent-to-own homes in Dallas, TX: a research guide

By Rent to Own Guide · Published · How we research

Short answer
In Dallas, a lease with an option to buy falls under Texas's executory-contract law, but a lease-option of three years or less gets only limited protections, so most of the checking is up to you. Before you pay an option fee, confirm the owner and any liens in Dallas County Clerk records, get a tax certificate, and have the contract reviewed. On October 19, 2026, the Dallas Homebuyer Assistance Program, now run by BCL of Texas, was taking applicants, with up to $60,000 in High Opportunity Areas.

The Texas rules in brief

Texas Property Code Subchapter D treats an option combined with a residential lease as an executory contract. For terms of three years or less, the protections that apply are a formal default notice with 30 days to cure, a cap on late fees, a ban on forfeiting your option fee for a late payment, a requirement that the seller own the home free of liens, and cancellation if the lot wasn't properly platted (Prop. Code §§ 5.062–5.085). Disclosures, recording, and annual statements are required only for longer terms. Details and a full table: Texas guide.

These are Dallas County offices. Parts of the City of Dallas lie in neighboring counties; if the home is one of them, use that county's appraisal district, clerk and tax office.

  1. Owner of record: Dallas Central Appraisal District. Search by owner, account number or street address, and check that the name matches the person offering the deal. DCAD is an appraisal record, and it says so: “Title research should be performed at the appropriate County Clerk's office” (DCAD).
  2. Mortgages and liens: Dallas County Clerk. Search the owner's name in the Clerk's official records search for deeds of trust, liens and releases. Searching is free; copies of documents cost a per-page fee. The site shows the date its index is certified through, so the newest filings may not appear yet, and it says the online database isn't the official repository. A recorded mortgage matters: § 5.085 bars the deal unless strict conditions are met.
  3. Property taxes: Dallas County Tax Office. Look up the account on the Tax Office site, or get an official tax certificate, which shows any delinquent taxes, penalties and interest owed. It costs $10 (Tax Office), in person or by mail at 500 Elm Street, Suite 1200, Dallas, TX 75202 (Tax Office, updated July 2026).
  4. Title company. Ask for a title search before you pay an option fee, and ask whether you'll be able to buy title insurance at closing.

Homebuyer help in Dallas (status checked Oct 19, 2026)

  • Dallas Homebuyer Assistance Program (DHAP): since May 1, 2026, Business and Community Lenders of Texas (BCL of Texas) runs the program for the City. It lends up to $60,000 for homes in High Opportunity Areas and up to $50,000 elsewhere in Dallas, as an interest-free second loan with no monthly payments that is forgiven over the time you live in the home; part is repaid if you sell, lease or transfer it. You need household income at or below 80% of area median income, a signed purchase contract, approval for a first mortgage, a housing payment no higher than 35% of gross income, and a price of $342,000 or less (City of Dallas). BCL also asks for a DHAP-approved lender and a homebuyer education certificate from a DHAP provider. On our check date BCL was taking applicants through a short Readiness Check; funding is first come, first served and not guaranteed (BCL of Texas, (214) 919-1866).
  • For rent-to-own buyers: DHAP needs a signed purchase contract and a mortgage, so it helps when you exercise your option and close, not during the lease. Start the lender and homebuyer-education steps early.
  • DHAP 10: up to $50,000 for people who have lived in Dallas for at least ten years, buying in designated areas, with income from 50% to 120% of area median income. The program's targeted-occupations track has spent all its funds (City of Dallas).
  • TDHCA My First Texas Home: statewide, 2% to 5% down payment assistance with a 620 minimum middle score (program matrix, Aug 17, 2026).
